DMCA Policy (camoncam.us)

CamOnCam (“we”, “us”, “our”) respects the intellectual property rights of others and expects users and partners to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how we handle copyright infringement claims and counter-notices.

If you believe that content available on camoncam.us infringes your copyright, you may submit a DMCA takedown notice to us. If you believe a takedown was submitted in error, you may submit a counter-notice.

1) How to Submit a DMCA Takedown Notice

To be effective under the DMCA, your notice must include all of the following:

  1. Your contact information: full legal name, mailing address, telephone number, and email address.
  2. Identification of the copyrighted work you believe has been infringed (or a representative list if multiple works are covered).
  3. Identification of the allegedly infringing material and information reasonably sufficient to locate it on our site (e.g., the exact page URL(s)).
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.
  6. Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).

2) Where to Send a DMCA Notice

3) What Happens After We Receive a Valid Notice

After receiving a complete and valid DMCA notice, we may:

  • remove or disable access to the allegedly infringing material, and/or
  • notify the party who posted or controls the material (when applicable).

We may request additional information if your notice is incomplete. We also may share your notice (including your contact details) with the affected party as required by the DMCA.

4) Counter-Notification Procedure

If you believe your material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. A valid counter-notice must include:

  1. Your contact information: full legal name, mailing address, telephone number, and email address.
  2. Identification of the material that was removed/disabled and the location where it appeared before removal (include URL(s)).
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, the jurisdiction of a Federal District Court where we may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.
  5. Your physical or electronic signature (typing your full legal name is acceptable).

If we receive a valid counter-notice, we may forward it to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, we may restore the material as permitted by the DMCA.

5) Repeat Infringers

In appropriate circumstances, we may terminate or restrict access for users or partners who are repeat infringers.
